Section 1. Application of These Terms
1. These "AI Feature Terms" (these "Terms") are special provisions of the Terms of Service (the "Original Terms") for the service "microCMS" (the "Service") provided by microCMS Inc. (the "Company"). Unless otherwise expressly stated, abbreviations used in these Terms follow the Original Terms.
2. These Terms apply to Users who agree to use supplementary features utilizing artificial intelligence (the "Features") provided within the Service.
3. If these Terms conflict with the Original Terms, these Terms shall prevail.
4. Matters not specified in these Terms shall remain governed by the provisions of the Original Terms.
Section 2. The Features
1. Users may use the Features in accordance with conditions established by the Company.
2. Intellectual property rights relating to the content constituting the Features, screen designs, programs, AI models, and the like belong to the Company, entities or individuals designated by the Company, or legitimate right holders who have granted licenses to the Company. Permission from the Company for Users to use the Features does not constitute a license of intellectual property rights beyond the scope necessary for use of the Features.
Section 3. Use of Information
The Company shall use Input Information, etc. (including prompts entered to generate content such as review results and other content output through the Features, and information entered by Users on the Service, but not limited to these) only to the extent necessary for Users to use the Features (including transmission to External Providers as defined in Section 4). This Section shall take precedence over Section 23, Paragraph 1 of the Original Terms.
Section 4. Integration with Third-Party Services
1. The Features may integrate with services operated by third parties other than the Company, such as OpenAI, Inc. and OpenAI OpCo, LLC (each an "External Provider" in this Section) (each a "Third-Party Service" in this Section); however, the Company does not guarantee that such integration will continue (including integration with any specific Third-Party Service).
2. Input Information, etc. may be provided from the Company to External Providers. Users understand that, when such provision is made, External Providers may review the provided information for purposes such as investigating violations of laws or prohibited acts or for monitoring, and Users shall use the Features at their own risk.
3. Users shall confirm on their own how Input Information is specifically handled by External Providers and shall use the Features at their own risk. The Company shall bear no responsibility for any damages incurred by Users arising from use of Third-Party Services.
4. When using the Features, Users shall review and comply, at their own risk, with the terms of use, agreements, and the like applicable between Users and External Providers (including those applicable when using Third-Party Services).
Section 5. Prohibited Acts
Users shall not engage in the following acts when using the Features (including acts that induce or prepare for such acts), and the Company may, without any procedure, suspend all or part of use of the Service or take other measures deemed appropriate by the Company when a User falls under any of the following or when the Company determines that there is a risk of such:
(1) Acts that violate these Terms
(2) Using the Features to cause output, or attempting to cause output, regarding matters that legally should be determined by professionals such as physicians, lawyers, certified public accountants, or tax accountants
(3) Using the Features to cause answers, or attempting to cause answers, with information whose transmission, sending, display, or the like is prohibited under the Original Terms or these Terms
(4) Using the Features for purposes other than the original purpose of service provision (including reproducing, republishing, or redistributing output results beyond the scope necessary for Users' business operations, as well as training other AI and machine learning models and generating prompts, but not limited to these)
(5) Prompt injection (including similar acts)
(6) Including personal information in Input Information, etc. under Section 3 (except when prior consent has been obtained from the individual concerned)
(7) Any other acts that the Company reasonably deems inappropriate
Section 6. Disclaimer
1. The Company shall make commercially reasonable efforts to improve the quality of content output through the Features, such as review results (collectively, "Output" in this paragraph); however, all Output is generated by generative AI, and whether such Output is optimal for Users depends on individual subjective judgment. The Company makes no warranty regarding the accuracy, reliability, usefulness, availability, fitness for a particular purpose, certainty, or safety of Output. The Company shall bear no responsibility for any damages suffered by Users arising from such Output.
2. The Company may, without prior notice to Users, change the specifications of the Features, terminate the Features, or temporarily suspend all or part of the Features. The Company shall bear no responsibility for any damages incurred by Users arising from measures taken by the Company under this paragraph.
3. The Features are intended for use in Japan, and the Company does not guarantee the legality of use outside Japan. Users shall confirm the laws and regulations applicable to them and shall use the Features outside Japan at their own risk. The Company shall bear no responsibility for any damages incurred by Users from such use, and Users shall compensate the Company for any damages suffered by the Company from such use.
